These terms apply when you use nimawellness.com, our booking page at book.nimawellness.com, our payment and plan links, and the NIMA mobile app. By using any of them, or by booking or paying for a service, you agree to these terms. If you do not agree, please do not use them.

1Who we are

Newport Integrative Medicine & Aesthetics, doing business as NIMA Wellness (“NIMA Wellness,” “we,” “us,” or “our”), is a physician-led medical practice located at 19782 MacArthur Blvd Suite 225, Irvine, CA 92612. We offer integrative medicine, hormone care, medical weight loss, medical aesthetics and related services.

2Using our website and app

You agree to use our website and the NIMA app only for lawful purposes, and not to:

• Give false information, or book or pay on someone else's behalf without their permission.
• Try to access accounts, records or systems that are not yours.
• Interfere with the site or app, or use automated tools to copy or overload it.
• Upload anything unlawful, harmful, or that you do not have the right to share.

Our Privacy Policy and Notice of Privacy Practices explain how we handle your information and are part of these terms.

3Appointments, cancellations and no-shows

• Please cancel or reschedule at least 24 hours before your visit — by the link in your text, in the app, or by calling us.
• A late cancellation or a missed visit may result in a fee, a forfeited deposit, or the loss of a session from a package, as stated in our Financial Policy you sign at intake.
• Arriving late may mean a shorter treatment or a new appointment.
• Booking a time does not guarantee a treatment. Your provider decides whether a service is right for you at your visit.

4Payments, packages and memberships

• Payment is due when services are provided, unless you have prepaid. Card payments are processed on Bank of America's secure payment page; financing is offered through Affirm and other lenders, subject to their approval and terms. We never see or store your full card number.
• Prices on our website and app may change. The price that applies is the one confirmed when you book or pay.
• Packages and custom plans are for the services listed when you buy them, are for your use only, and expire as stated at purchase.
• Monthly memberships are billed every month until you cancel. You can cancel anytime under the terms of your membership; cancelling stops future charges, and benefits continue until the end of the period you have paid for. Memberships paid once cover the term stated at purchase.
• Aesthetic and elective treatments are generally not covered by insurance, and we do not bill insurance on your behalf.

5Refunds

Treatments that have been performed are non-refundable, including product that has been opened or injected. Unused prepaid services, packages and memberships are handled under our Financial Policy. Results vary from person to person and fees are not refunded based on results, but your provider will always review a concern with you. Rewards points earned on a purchase are removed if that purchase is refunded.

6Text messages and email

If you give us your mobile number and agree to receive texts, NIMA Wellness will text you about appointments (confirmations, reminders and changes), forms to complete before a visit, payment and membership notices, links to video visits, and — only if you opt in to them — offers and practice news. We email the same kinds of messages.

• Message frequency varies. Message and data rates may apply.
• Reply STOP to any text to cancel. Reply HELP for help, or call us at (949) 763-9255.
• Consent to receive marketing texts is not a condition of any purchase.
• Carriers are not liable for delayed or undelivered messages.
• Every marketing email has an unsubscribe link. Opting out of marketing does not stop messages about an appointment or payment you have made.

7Medical disclaimer

Information on our website, in the app, in our posts, and from our website assistant is general education. It is not medical advice and does not create a patient relationship. Whether a treatment is right for you — and whether you are eligible for it — is decided only by a licensed provider after evaluating you. Individual results vary. In an emergency, call 911.

8Telehealth

Some visits take place by secure video (we use doxy.me). Telehealth has limits: your provider may not be able to examine you fully and may ask you to come in person. Providers can treat you by video only where they are licensed, so we may ask where you are at the time of the visit. An automated tool may summarize the visit for your chart; your provider reviews that summary. You may choose an in-person visit instead at any time.

9Accounts and age

You must be at least 18 to create an account, book, or pay online. Patients under 18 are seen only with a parent or legal guardian, who books and consents for them. Keep your login details to yourself and tell us right away if you think someone else has used your account. You can delete your app account at any time from our account deletion page.

10Intellectual property

The NIMA name and logo, MenDurance™, EmpowHer™, and the text, photos, videos and design of our website and app belong to NIMA Wellness or its licensors. You may view and share them for personal, non-commercial use. You may not copy, sell or reuse them otherwise without our written permission. Other product names, such as treatment brands, belong to their owners.

11Limitation of liability

Our website and app are provided “as is.” We work to keep them accurate and available but do not promise they will be error-free or uninterrupted. To the fullest extent the law allows, NIMA Wellness is not liable for indirect, incidental or consequential losses arising from your use of the website or app, and our total liability for any claim about them is limited to the amount you paid us for the service involved. Nothing in these terms limits liability for professional negligence or any right that cannot be limited under California law.

12Governing law

These terms are governed by the laws of the State of California. Any dispute will be heard in the state or federal courts located in Orange County, California, unless the law requires otherwise.

13Changes to these terms

We may update these terms as our services or the law change. The date at the top shows the latest version. Changes apply from that date and do not affect a purchase you made before it.
